Forest Management Agreement (FMA) - Public Engagement

Background

Section 14(1) of the Forestry Act provides the authority to remove Crown Timber within the province through either a Cutting Permit (Domestic or Commercial), Timber Sale Agreement, or a Crown Timber Licence (CTL).

The Department of Fisheries, Forestry and Agriculture is exploring options to provide additional commercial forestry opportunities within the province through the issuance of a CTL, which has the below requirements:

  • The assignment of the timber rights within a defined geographical location
  • Long term arrangement over a 20 year period, with five year review/renewal cycles
  • Development of a Forest Management Agreement (FMA)
    • Agreement that assigns Timber Rights only, which is not permitted to be transferred, reassigned or used as security for debt
    • Agreement is not a treaty or land claim agreement within the meaning of section 25 or section 35 of the Constitution Act, 1982
    • Non Forestry Crown Rights are not to be impacted or restricted
    • The recipient of an FMA must have a timber processing facility with a detailed business plan, supporting rationale for a Timber Licence
